I have a friend who probably did it more times while trying to convince his girlfriend he was kidnapped 3 weekends in a row...LOL..

I find it odd he would plead Guilty in the Criminal case(US vs WARD) on Oct. 23rd, then ask for a delay(stay) in the Civil case, on Oct. 26th, because answering questions in the Civil case would make him look more guilty in the Criminal case????, which he has now plead guilty to.

Must be some kind of legal logic that has no basis in common sense and only matters in legal areas, the twilight zone of common sense.

And no where near a record, some of the music download/upload cases had many more, "I plead the 5th", in the thousands I believe.

I contacted the police headquater and was told that unless you were convicted and sentenced then you have a criminal record; otherwise, they wont record it to the central system. In your case, there would be no criminal record.

In Florida state and county courts records are wide open .Florida has a law called the Sunshine Law. The Sunshine Law opens almost all records to the public . Family and mental cases are closed most of the time . Unless a person goes to court after being found not guilty and has his or her case records removed by a Judge, Some of the info will remain .

Not sure about Federal law.

Someone correct me if i'm wrong. But if you pled the 5th you cannot answer anyother questions when asked!:eek:

Yes I think thats correct, "taking the 5th" while in the witness box in Court means you answer no questions at all, even "whats your name", it also means you can answer no questions in your defense as well, but it could depend on the Judge as well.
Answering questions with "I don't recall" is better than "the 5th" because a Judge can through you in jail for contempt if you don't answer questions, thats THEIR right, lol, and "I don't recall" is an answer.
